What Is Collaborative Law?
Collaborative law is a relatively new concept that is being used in divorce cases. In a collaborative law divorce, the husband and wife are each represented by their own collaborative law attorney.
The parties as well as the attorneys agree to seek resolution of all property, custody, visitation and other matters pertinent to the divorce without the necessity of trial. If either spouse decides to take the case to trial, both lawyers must withdraw from further representation of the parties.
The keys to the collaborative law process are open communication and disclosure. The parties as well as their attorneys have the ability to freely communicate. Unlike the traditional divorce setting in which attorneys do most of the communication for their clients, husbands and wives in a collaborative law divorce are encouraged to communicate freely and directly in the presence of their attorneys at group meetings.
Although husbands and wives retain the right to hire their own expert to determine the value of a house or other property, parties to a collaborative law divorce often agree to hire a neutral expert who is instructed to provide an honest and objective valuation of property.
